New Delhi, July 15 (Inditop.com) The Delhi High Court Wednesday rejected the bail plea of Saquib Nisar, a suspected Indian Mujahideen terrorist allegedly involved in the Sep 13 Delhi serial bombings who wanted to appear in the MBA examination.
Nisar, arrested Sep 20 and currently in custody of the Gujarat police, had approached the court stating that his final semester exams were scheduled to start July 18.
Delhi Police told the court that the Gujarat police needed his custody till July 28 as they have not filed the charge sheet in a terrorism case in that state.
Nisar’s lawyer then urged the court to postpone the exams for him.
Justice Geeta Mittal, however, rejected the plea.
The high court had earlier refused to grant Nisar interim bail when he was to appear in the fifth semester exams and had allowed him to write his papers from jail.
His counsel Wednesday pleaded before the court that the gravity of the allegations cannot and should not bar the right of any accused to pursue studies.
Delhi Police have already filed a charge sheet against Nissar and the other accused – Mohammed Saif, Zeeshan Ahmed, Zia-ur Rehman and Mohammed Shakeel in the Sep 13 serial blasts at five places in the heart of the capital that claimed 25 lives.
They have been accused of murder, attempt to murder and waging war against the nation among other offences under the Indian Penal Code, the Unlawful Activities (Prevention) Act and the Explosive Substances Act.
