New Delhi, Jan 8 (Inditop.com) Scandal-hit N.D. Tiwari seemed headed for fresh trouble Friday after the Delhi High Court sought his response to the appeal of Rohit Shekhar, who claims to be the biological son of the veteran politician.

Admitting the appeal, a division bench of Chief Justice Ajit Prakash Shah and Justice Rajiv Sahai Endlaw asked the 86-year-old Tiwari to file his response by Feb 9, the next date of hearing.

Shekhar has challenged the single-judge bench order of November last year that had dismissed his paternity suit.

“My suit was about meeting with legal status from N.D. Tiwari, who has denied me the status of his son,” he said in his appeal, mentioning his suit cannot be rejected on the grounds that he filed it much after he attained majority as he had produced several medical records to show that he was not in a condition to do so.

“I was suffering from brain haemorrhage and also had a heart attack in the last 10 years. The court must have appreciated these facts. I should be given a chance to face trial and should be allowed to prove why I got delayed in filing the suit,” the 29-year-old Shekhar said.

The single bench order clearly stated that according to the order 7, rule 11 of the Civil Procedure Code (CPC), a person can file a paternity suit within three years after he has attained the age of majority.

According to Shekhar’s petition, Tiwari began neglecting him and his mother Ujjawala Sharma after 1995 and refused to meet Shekhar m when he visited Tiwari’s residence either in Delhi or in Uttranchal when he became the chief minister.

Ujjawala Sharma said: “Paternity is a continuous cause of action and it cannot come under the limitation act. Those were filmsy grounds for rejecting the petition.”

According to her, Tiwari used to accept her as a wife and Rohit as his son but in 2005 she came to know that he was giving false assurances when he began neglecting her and Rohit on a number of occasions.

Tiwari’s five-decade-old political career came to a virtual end after a news channel showed explicit clippings of an elderly man purported to be 86-year-old Tiwari with three young women in bed last month.

A few days after the news broke, Tiwari resigned from his post as Andhra Pradesh governor, on health grounds.
