New Delhi, Jan 21 (Inditop.com) The Supreme Court Thursday decided to accord an early hearing to a plea for suspension of the bail of Vishal Yadav, jailed for life along with his cousin Vikas Yadav for murdering their sister Bharti’s friend Nitish Katara.
A bench of Chief Justice K.G. Balakrishnan, Justice J.M. Panchal and Justice B.S. Chauhan advanced the hearing of the plea by the slain youth’s mother Neelam Katara from Feb 1 to Jan 25.
The bench advanced the hearing after Katara’s counsel Kamini Jaiswal told the court that her plea for cancelling the bail is pending with the court’s registry and has been slated for hearing on Feb 1, ironically a day after Yadav’s bail ends on Jan 31.
She told the court that the Delhi High Court Jan 14 granted Vishal bail till Jan 31 and her plea would become invalid by Feb 1.
The high court had given bail to Yadav on his plea that he had to perform certain religious rituals – only done by a brother – during the marriage of his sister.
In her lawsuit, Katara said that it was not necessary for the high court to grant bail to Yadav as he had another brother, Vivek Yadav, who could have very well performed them in his absence.
Katara’s lawsuit also assailed the high court’s reasoning for granting bail on the ground that he had to arrange the finances for his sister’s marriage.
She said that the property, which was to be sold purportedly for arranging the finance had already been sold by the family last year.
