Ahmedabad, June 29 (IANS) A woman Tuesday moved the family court here seeking maintenance from the biological father of her five-year-old son.
The court has issued notice to the biological father of the boy returnable Aug 16.
The woman had earlier accused the boy’s father of rape and dragged him to court which sentenced him to jail. He was later acquitted by the Gujarat High Court.
According to the woman’s lawyers Shamshad Pathan and Asif Sheikh, she has now sought Rs.9 lakh for the past five years during which she brought up the child.
She has also sought monthly maintenance of Rs.15,000 from the child’s biological father Rajkumar Ramaswamy Adi Dravid.
Pathan said that the woman was 17 years old when she got involved in an affair with 21-year-old Dravid in 2004.
The relationship turned physical on promise of marriage and she became pregnant.
Dravid subsequently refused to marry her and the woman filed a complaint of rape, leading to his arrest.
Additional sessions judge, Ahmedabad rural, Yoginiben Upadhayay in her judgment delivered Dec 31, 2007 found Dravid guilty and sentenced him to 7 years imprisonment.
Subsequently, Dravid went in appeal before the Gujarat High Court in January 2008 which gave a decision acquitting him in March 2010 on the grounds that the two had consensual sex.
A DNA test conducted during the sessions trial had conclusively proved that Dravid was the biological father of the woman’s child, her lawyer said.
