Gandhinagar, Sep 29 (IANS) The Gujarat High Court has fined the Choksi Tube Company Rs.10,000 for ‘misusing the court’s jurisdiction’.
The company reportedly filed a writ petition that was dismissed for non-prosecution in August. The firm then moved an application for restoration of the case for which the court issued notice returnable Oct 25.
However, the company preferred an appeal under clause 15 of the Letters Patent Appeal.
After hearing the counsel for the company, Chief Justice S.J. Mukhopadhaya and Justice Anant Dave noted: ‘This is a gross misuse of jurisdiction of the court for which the court is not only inclined to dismiss the case but also inclined to impose costs.’
A copy of the order was made available Wednesday.
