New Delhi, Sep 23 (IANS) The Delhi High Court Thursday framed issues on a suit pertaining to a custody battle between the brothers and wife of ailing socialist leader and former defence minister George Fernandes.

Justice V.K. Shali framed the issues on the maintainability of the suit and whether Fernandes’ brothers were entitled to get the custody of the former convenor of the National Democratic Alliance.

The socialist leader’s brothers, Richard and Michael, also moved an application Thursday seeking details of his medical prescriptions and other health documents.

The court issued notice to Leila Kabir Fernandes, wife of the ailing leader, to appear before the court’s joint registrar with all the documents Nov 10.

The brothers of Fernandes have sought the custody of their brother alleging that his wife was not treating him properly.

Earlier, Fernandes’ brothers in their argument before the court submitted that he should be treated by the same doctors of the All India Institute of Medical Sciences where his treatment was on earlier.

But Kabir objected to their plea saying that Fernandes was undergoing a better treatment at a private hospital.

The court July 5 said that there was no need for the ailing leader to change his place of residence and permitted his wife to take care of him.

The court passed the direction after having one-on-one discussion with Fernandes.
